Terms of Service

GateAway is a software service provided by Adelchi Brignoli (tax code BRGDCH89M13F119Y, Via Mozart 18, 20050 Liscate, MI, Italy) that lets you create travel itineraries and share them with your clients via a private link.

To register you must be at least 18 years old. You are responsible for the confidentiality of your credentials and for the activity carried out through your account. Notify us immediately in case of unauthorized use.

By entering third-party data (the travelers) you declare that you have a legal basis to process it and that you have adequately informed them. In respect of this data you are the Controller; GateAway acts as a Processor on your behalf, under the relevant data processing agreement (DPA).

GateAway is an organization tool. Times, flights, prices, addresses and information — including that generated by artificial intelligence — may contain errors, inaccuracies or changes. You are required to verify them before sharing them with clients. GateAway is not liable, to the extent permitted by law, for disruptions, losses or damages arising from incorrect, incomplete or outdated information in the itineraries; consumers’ mandatory rights remain unaffected.

The full rules — prohibited content, responsibilities when publishing to the showcase, AI usage, prohibited conduct, how to report abuse and what happens if the rules are broken — are set out in the Acceptable Use Policy, which forms part of these Terms.

You may not use the service for unlawful purposes, nor upload illegal content or third-party data without a valid legal basis. In particular, do not upload special-category data (Art. 9 GDPR: health, religion and the like) unless you have a valid condition under Art. 9(2) GDPR (e.g. the data subject’s explicit consent); minimize such data.

The content you upload remains yours. You grant us the right to process it solely to provide you with the service (e.g. storage, itinerary generation, link sharing).

Within the mandatory limits of the law, the service is provided "as is" and we do not guarantee that it will always be free of interruptions or errors. Nothing in these terms excludes or limits liability for wilful misconduct or gross negligence or for personal injury, nor does it curtail the mandatory rights of consumer users.

GateAway offers a permanent free plan (1 trip per month) with no automatic charge. For the paid plans (Monthly €4.90 · Yearly €49) the service relies on Lemon Squeezy, acting as Merchant of Record: the transaction, invoicing and VAT handling are governed by Lemon Squeezy’s terms of sale; Adelchi Brignoli provides the software and the guarantees on the digital service. Before purchase you are shown the pre-contractual information (Art. 49 Italian Consumer Code); the order is completed on the Lemon Squeezy checkout, where the button clearly states the obligation to pay and you receive confirmation on a durable medium by email.

• Prices: the amounts shown are the total due; VAT, where applicable, is included or calculated at checkout based on residence.
• Automatic renewal: the subscription renews for successive periods of equal duration unless cancelled before renewal. You can cancel at any time from your account; cancellation takes effect at the end of the period already paid.
• Withdrawal (consumers): you have 14 days from the conclusion of the contract to withdraw without giving a reason (Art. 52 Consumer Code). If at checkout you expressly request immediate activation, performance begins at once: you may still withdraw within the 14 days and only a proportionate amount for the service used up to the withdrawal notice will be retained (Art. 57(3) Consumer Code); in the absence of such an express request, withdrawal gives the right to a full refund. To withdraw, send an explicit statement to amministrazione@gateaway.world indicating the order number (shown in the purchase confirmation email), needed to identify the purchase (see the model form below); the refund is handled through Lemon Squeezy.
• Price changes: communicated in advance; if you do not accept them you can cancel before they take effect.

We may update these terms or suspend the service in case of breaches. Significant changes will be communicated.

These terms are governed by Italian law. For consumer users, the court of the consumer’s place of residence or domicile has mandatory jurisdiction. For other users (professionals), the court of Milan has jurisdiction.

If you act as a consumer, the legal guarantee of conformity for digital services applies (Arts. 135-octies et seq. Consumer Code): the service is guaranteed to be conforming for the entire duration of the subscription. In case of a defect you are entitled to restoration of conformity, a proportionate price reduction or termination of the contract, under the conditions of the law.

If you use GateAway in a professional capacity (advisor or agency), pursuant to Arts. 1341-1342 of the Italian Civil Code you specifically approve: Art. 4 (accuracy of content and AI-generated itineraries), Art. 7 (limitations of liability), Art. 9 (unilateral amendment and suspension of the service), Art. 10 (court of Milan). These clauses do not apply to consumer users.

On itineraries shared with the free plan, and on all pages of the public showcase (“Explore”), a link to third-party booking services (e.g. GetYourGuide) may appear next to some activities. These are affiliate links: if the traveler makes a booking, the Controller may receive a commission from the third-party provider, at no additional cost to the user or the traveler. The choice, purchase and contract take place exclusively on the third-party provider’s site, under its terms and privacy notice; GateAway is not a party to such transactions nor responsible for the related services. Private links shared with a paid plan do not contain affiliate links; the public showcase, being a space managed by GateAway, may contain them regardless of the creator’s plan.

The user may choose to publish their itineraries in the public showcase (“Explore” page). Publication is optional and can be enabled/revoked at any time from the trip page.

The itinerary is shown in anonymized form: the system automatically removes the client name, real dates, documents and private notes, publishing only the trip structure (days and stops) together with the creator’s public data (name/brand, logo, contacts and socials). Before publication the system flags any booking data detected in the free-text fields, but that check is an automated aid and does not replace the user’s verification. The user warrants that they have the rights to the content they publish and that they do not include third-party personal data in the fields made public (titles, descriptions, tips), and remains solely responsible for the published content.

By publishing, the user grants GateAway a non-exclusive, royalty-free licence to display, reproduce and make the content accessible for the operation of the showcase, while remaining its owner. If they enable importing, they authorize other users to clone the itinerary into their own account to customize it (with attribution to the original author).

The creator’s public data (brand, logo, contacts, socials) becomes visible to anyone: it is the user’s choice, for their own promotion. GateAway may remove or suspend, at its discretion, published content that is unlawful, misleading, harmful to others’ rights, spam or of inadequate quality, notifying the creator. The ratings (stars) are given by users who imported the itinerary and reflect personal opinions. GateAway does not guarantee and is not responsible for content published by users.

The order number is needed to identify the purchase and process the refund: without it the request may not be actionable.
